Requests for information under the Data Protection Act
The Data Protection legislation gives every living person the right to know what personal information e.g. relating to their health, medical records, their employment an organisation holds about them. To exercise this right, you can make what is known as a ‘subject access request’ using the form Application for Subject Access to Clinical Records or Application for Subject Access to Non Clinical Records.
The Access to Health Records Act 1990 (AHR) gives statutory right of access to a deceased persons’ health record. It should be noted that relatives of someone who has died have no right of access to the deceased’s records unless they are their personal representative e.g. administrator or executor. If you have a claim as a result of a person’s death, you can only see information that is relevant to the claim, in the majority of cases only the last episode of care. Applications can be made using the form Access to Deceased Persons Health Records.
